Welcome to The Aras Music Festival ("ARMF," "we," "us," "our")! These Terms and Conditions ("Terms") govern your purchase of tickets and attendance at ARMF events, as well as your use of our website and services (collectively, "Services"). By purchasing a ticket, attending an event, or using our website at www.arasfestival.com, you agree to be bound by these Terms. If you do not agree to these Terms, please do not purchase tickets or attend our events.

2. Eligibility

You must be at least 21 years of age to purchase tickets or attend ARMF events. By purchasing a ticket or attending an event, you confirm that you meet this age requirement and will provide valid government-issued photo identification upon request at the event entrance. Events are strictly age-restricted, and no exceptions will be made.

3. Account Registration

To purchase tickets through our website, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration

  • Maintain and update your account information to keep it accurate

  • Safeguard your password and any activities that occur under your account

  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. ARMF is not liable for any loss or damage arising from your failure to protect your account credentials.

4. Ticket Purchase and Payment

4.1 Purchase

All ticket sales are processed through our secure payment gateway. By purchasing a ticket, you agree to pay the full ticket price plus any applicable taxes and processing fees at the time of purchase.

4.2 Accepted Payment Methods

We accept major credit/debit cards, UPI, net banking, and digital wallets through our authorized payment processor.

4.3 Confirmation

Upon successful payment, you will receive a confirmation email with your e-ticket containing a unique QR code. This e-ticket is required for entry to the event.

4.4 Pricing

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes. Ticket prices are subject to change without notice until payment is confirmed.

4.5 Payment Security

ARMF does not store your payment card information. All payments are processed through secure, PCI-compliant third-party payment processors.

6. Entry Requirements and Event Conduct

6.1 Age Verification

All ARMF events are strictly 21+ only. Valid government-issued photo identification (Aadhaar Card, Driving License, Passport, or Voter ID) is mandatory for entry. Age verification will be conducted at the venue entrance. No entry will be permitted without valid ID proving you are 21 years of age or older.

6.2 Entry Conditions

To gain entry to an ARMF event, you must present:

  • Your valid e-ticket with QR code (digital or printed)

  • Valid government-issued photo ID matching the name on the ticket

  • Proof of age (21+)

6.3 Denial of Entry

ARMF reserves the right to deny entry without refund if:

  • You are under 21 years of age

  • You do not have valid identification

  • You appear intoxicated or under the influence of drugs

  • You are behaving in a threatening, abusive, or disruptive manner

  • Your ticket is fraudulent, duplicated, or obtained through unauthorized means

  • The venue has reached maximum capacity

  • You are in possession of prohibited items

6.4 Removal from Event

ARMF reserves the right to remove any attendee from an event without refund for:

  • Violation of venue rules or these Terms

  • Harassment, violence, or threatening behavior toward staff or other attendees

  • Possession or use of illegal drugs or prohibited items

  • Excessive intoxication posing a safety risk

  • Any behavior deemed unsafe, disruptive, or illegal

6.5 Re-Entry

Once you exit the event venue, re-entry is not permitted except in case of genuine emergencies at ARMF's sole discretion.

7. Prohibited Items and Behavior

7.1 Prohibited Items

The following items are strictly prohibited and will be confiscated at entry:

  • Outside food or beverages (including alcohol)

  • Weapons of any kind (knives, firearms, explosives, sharp objects)

  • Illegal drugs or controlled substances

  • Professional camera equipment (DSLR cameras, video cameras, recording equipment)

  • Fireworks, flares, pyrotechnics, or explosives

  • Laser pointers

  • Large bags or backpacks (subject to security search)

  • Glass containers or bottles

  • Drones or remote-controlled devices

  • Pets (except registered service animals with proper documentation)

  • Any item deemed dangerous or disruptive by security staff

Personal phone cameras and small point-and-shoot cameras are permitted for personal, non-commercial use.

7.2 Prohibited Behavior

By attending an ARMF event, you agree NOT to:

  • Engage in harassment (sexual, verbal, or physical) of any kind

  • Use or distribute illegal drugs or substances

  • Tamper with others' food or drinks (spiking, drugging)

  • Engage in violence, threats, or physical altercations

  • Use hate speech or engage in discriminatory behavior

  • Record or livestream the event for commercial purposes without permission

  • Destroy or damage venue property

  • Trespass into restricted areas (backstage, VIP areas without proper access)

  • Engage in any illegal activities

Zero Tolerance Policy: ARMF has zero tolerance for harassment, violence, drug use, or illegal activities. Violators will be immediately removed from the venue, and law enforcement will be contacted if necessary.

8. Alcohol Consumption

8.1 Service of Alcohol

Alcoholic beverages may be served at ARMF events to guests 21 years of age and older only. Valid ID is required for all alcohol purchases and consumption.

8.2 Responsible Consumption

You are responsible for your own alcohol consumption. ARMF and venue staff reserve the right to refuse alcohol service to anyone showing signs of excessive intoxication. Over-intoxication may result in denial of further service or removal from the venue.

8.3 Outside Alcohol

Outside alcohol is strictly prohibited. Any alcohol brought into the venue will be confiscated.

8.4 Don't Drink and Drive

Do not drink and drive. ARMF encourages the use of designated drivers, taxi services, or rideshare apps. We can assist in arranging safe transportation if needed.

9. Safety and Security

9.1 Security Measures

For the safety of all attendees:

  • All persons and bags are subject to security screening upon entry

  • CCTV surveillance is in operation throughout the venue

  • Trained security personnel are present at all times

  • We reserve the right to refuse entry or remove anyone posing a safety risk

9.2 Medical Services

First aid teams and medical staff will be present at all ARMF events. In case of medical emergency, please alert any staff member immediately or proceed to the designated first aid station.

9.3 Emergency Procedures

In case of emergency, please follow instructions from ARMF staff and security personnel. Emergency exits are clearly marked throughout the venue. Do not use emergency exits except in case of actual emergency.

9.4 Attendee Responsibility

You attend ARMF events at your own risk. While we take extensive safety measures, you are responsible for your own safety and well-being. ARMF is not liable for injuries, accidents, or losses except where caused by our negligence.

10. Photography, Videography, and Media

10.1 Event Photography and Videography

Professional photographers and videographers will be present at ARMF events to capture content for promotional purposes. By attending an event, you:

  • Consent to being photographed, filmed, or recorded

  • Grant ARMF a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, distribute, and display such media in any format for promotional, marketing, or commercial purposes

  • Waive any right to compensation or approval for such use

10.2 Personal Photography

Personal photography and videography using mobile phones and small cameras is permitted for non-commercial, personal use only. You may not:

  • Use professional camera equipment without prior authorization

  • Record or livestream the entire event for commercial purposes

  • Sell, license, or commercially exploit any photos or videos taken at the event

10.3 Privacy of Others

When taking photos or videos, please respect the privacy of other attendees. Do not post photos or videos of others on social media without their consent.

11. Intellectual Property

11.1 ARMF Brand and Content

"The Aras Music Festival," "ARMF," and all associated logos, designs, graphics, and branding are the intellectual property of ARMF. Unauthorized commercial use, reproduction, or distribution of ARMF's intellectual property is strictly prohibited.

11.2 Event Themes

Certain ARMF events may be inspired by popular culture, films, or TV shows (e.g., "Stranger Things"). These themes are used for entertainment purposes only and do not imply official affiliation, endorsement, or partnership with the original creators, studios, or rights holders unless explicitly stated.

11.3 User-Generated Content

If you post content about ARMF events on social media or other platforms, you grant ARMF a non-exclusive, royalty-free license to share, repost, or use such content for promotional purposes. You retain ownership of your content.

12. Limitation of Liability

12.1 Disclaimer of Warranties

ARMF provides events and services on an "as-is" basis. To the fullest extent permitted by law, we make no warranties or representations regarding:

  • The safety, quality, or suitability of events

  • The accuracy or completeness of event information

  • The availability or performance of services

12.2 Limitation of Liability

To the maximum extent permitted by law, ARMF, its affiliates, partners, employees, agents, and licensors shall not be liable for any:

  • Personal injury, illness, or death (except where caused by our negligence)

  • Loss, theft, or damage to personal property

  • Indirect, incidental, consequential, or punitive damages

  • Loss of data, profits, or business opportunities

  • Damages arising from your attendance at events or use of our services

Your sole remedy for dissatisfaction with ARMF events or services is to stop attending our events.

12.3 Assumption of Risk

You acknowledge that attendance at live events involves inherent risks, including but not limited to:

  • Crowds and confined spaces

  • Loud music and noise exposure

  • Physical activity (dancing, movement)

  • Weather conditions (for outdoor events)

  • Actions of other attendees

By attending an ARMF event, you voluntarily assume all such risks.

12.4 Indemnification

You agree to indemnify, defend, and hold harmless ARMF, its affiliates, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms

  • Your attendance at events

  • Your conduct or behavior

  • Any content you post or share

13. Force Majeure

ARMF shall not be liable for failure to perform its obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, storms, natural disasters)

  • Extreme or dangerous weather conditions

  • Government orders, restrictions, or regulations

  • Public health emergencies (pandemics, epidemics)

  • Acts of terrorism, war, or civil unrest

  • Venue unavailability or damage

  • Strikes or labor disputes

  • Technical failures beyond our control

In such cases, ARMF will make reasonable efforts to reschedule events or provide refunds as appropriate, at our sole discretion.

  • Follow all instructions from ARMF staff and security personnel

  • Comply with all applicable laws and regulations

  • Create a welcoming, inclusive environment for all

We do not tolerate:

  • Discrimination based on race, gender, sexual orientation, religion, disability, or any other protected characteristic

  • Harassment or bullying of any kind

  • Disruptive or disorderly conduct

ARMF is committed to fostering a safe, respectful, and inclusive community. Violations of these guidelines may result in removal from events and permanent ban from future ARMF events.

16. Changes to Events

16.1 Right to Modify

ARMF reserves the right to make changes to:

  • Event schedules, timings, or duration

  • Performers, artists, or DJs (though we will make best efforts to honor advertised lineups)

  • Venue layout, amenities, or services

  • Food and beverage offerings

  • Any other event details

16.2 Notification

Significant changes will be communicated to ticket holders via email, SMS, or announcements on our website and social media. Minor changes may not be individually notified.

16.3 No Refunds for Changes

Changes to event details (other than complete cancellation) do not entitle ticket holders to refunds. Your sole remedy is to transfer your ticket as per Section 5.3.

17. Lost or Stolen Tickets

17.1 Responsibility

You are responsible for safeguarding your e-ticket and QR code. ARMF is not responsible for lost, stolen, or compromised tickets.

17.2 Replacement

If you lose access to your e-ticket:

  • Contact us immediately at support@arasfestival.com

  • Provide your booking ID, name, and email address

  • We will verify your purchase and resend your e-ticket

If your ticket has already been scanned for entry, we cannot issue a replacement.

17.3 Fraudulent Tickets

Tickets obtained from unauthorized resellers or third parties may be invalid. ARMF is not responsible for fraudulent tickets. Purchase tickets only through official ARMF channels.

18. Vendor and Partner Relationships

ARMF may partner with third-party vendors for:

  • Accommodation booking services

  • Transportation or shuttle services

  • Food and beverage services

  • Merchandise sales

These vendors operate independently, and ARMF is not responsible for their actions, products, or services. Any disputes with vendors should be resolved directly with them.

19. Governing Law and Dispute Resolution

19.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or your attendance at ARMF events shall be subject to the exclusive jurisdiction of the courts in Nainital, Uttarakhand, India.

19.2 Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us at legal@arasfestival.com. If the dispute cannot be resolved informally, it shall be settled through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

19.3 Class Action Waiver

You agree to resolve disputes with ARMF on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21. Waiver

ARMF's failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. No waiver of any provision shall be effective unless made in writing and signed by an authorized representative of ARMF.

22. Entire Agreement

These Terms, together with our Privacy Policy and any event-specific terms, constitute the entire agreement between you and ARMF regarding your purchase of tickets and attendance at events. These Terms supersede all prior agreements, understandings, or representations.

23. Amendments to Terms

23.1 Right to Modify

ARMF reserves the right to modify, update, or amend these Terms at any time without prior notice. Changes will be effective immediately upon posting on our website at www.armf.in/terms-and-conditions-the-aras-music-festival.

23.2 Notification of Changes

If we make material changes to these Terms, we will notify you via:
